On the basis of the considerations outlined above and having to apply the legal principles espoused by the Supreme Court of Appeal, and inĀ correlation with the limited areas of cognizance of the precautionary measures, we find that the state has no elements of proof against the accused that would reach the necessary threshold of seriousness required in terms of article 273 of the Criminal Procedure Code with regard to the charges under article 416 bis of the Criminal Code, so that the appeal must be granted, and consequently the custody measures are hereby revoked, and the further exceptions and defences put forward by Palazzolo are absorbed into this judgment.
